Summer’s almost here and this presents a challenge for companies requiring employees to work outdoors during the summer season. Make sure that your job descriptions clearly reflect the essential functions of the job and any environmental considerations in the summer outdoor workplace such as heat, sunlight, rain, standing, walking, etc. The Americans with Disabilities Act and the amendments require employers to be very specific as to the details of the job to be performed and the work environment. It’s hard to turn away an applicant who says, “I can do that,” when there is no current job description to review.
